Terms and conditions

The website www.alterego-design.co.uk is run by ALTEREGO sprl, a belgian commercial company (European union).

The head office of ALTEREGO sprl is located Place Cathédrale, 5, 4000 Liège, Belgium. The company is registered in Liège with company code BE877.729.640.

For everyone of its sales, ALTEREGO sprl complies with:

· The Consumer Protection (Distance Selling) Regulations 2000

· The Electronic Commerce Regulations 2002

· The Consumer Protection from Unfair Trading Regulations 2008

If no written exceptions have been agreed between ALTEREGO sprl and its customers, every relation between ALTEREGO sprl and its customers is subjected to these terms and conditions which are known and accepted by the customer, even if those terms and conditions are opposed to their own terms and conditions or buying conditions. The terms and conditions are available in the languages used on this website.

The customer declares he is not going to resell the purchased products. Any distributors interested in the products of ALTEREGO have to contact ALTEREGO.

Prices

All our prices are INCLUDED taxes if no mention "excluded VAT" is made. The product offers and price lists are subject to any changes or corrections. Pictures of the products are not contractual.

Conclusion of the contract

When a buyer places an order on an item, the two parties will have entered into a legally binding contract. Every order confirmation brings acceptation of prices and descriptions of the products. While buying online, the customer accepts to conclude a contract of purchase with ALTEREGO and accepts these terms and conditions. The customer is informed of the confirmation of his order by an email describing the terms of the order. ALTEREGO commits itself to respect received orders on the website while stocks last.

If the products are not available, ALTEREGO sprl commits itself to inform the customer as soon as possible. The purchase contract between ALTEREGO sprl and its customers arises when ALTEREGO sprl accepts the order.

Delivery

The products are delivered by DPD, GEFCO & UPS in the countries where the website allows them to deliver. Insofar as ALTEREGO is able, the delivery will occur at the date informed in the order confirmation. Delivery period are so indicative even if they are respected at 90%. Possible delays will not involve any damages from ALTEREGO sprl. Any duty taxes, like import taxes owed will be paid by the consignee and will never be claimed back to ALTEREGO sprl.

Delivery costs and possible assembly costs will be paid by the customer in every situation except in case of opposite written stipulation.

Assembly are at customers' own risk.

Notwithstanding the article 1583 of belgian civil code, ALTEREGO sprl owns the sold goods until full payment of the principal amount and possible interest on arrears and damages.

In case of failed deliveries

In case the buyer is not present to check and sign for his parcel, the driver will leave him a notice and will come back the day after.

If the next day the buyer is still absent, the delivery man will leave him a second notice and the buyer will have to contact him within 5 days to fix an appointment with him.

After 3 failed attempts, the delivery man will leave the parcel into the undelivered DPD depot. The buyer will have then 7 days to pick it up before the parcel comes back to us.

ALTEREGO sprl cannot be held responsible for non delivery of items if the given delivery address is not correct or incomplete (i.e. no house name or number/street details etc).

Any liability for a returned delivery due to no one being present at the delivery address at the time of delivery will be with the buyer. If this should occur, then the buyer will be liable for the costs of the item to be returned to ALTEREGO sprl and then re-dispatched back to him.

Reception of your item

Immediately after receiving the goods, the purchaser has to manage a meticulous inspection of the goods and to inform the seller within 48 hours by email (info@alterego-design.co.uk ) in case of defects or damages from transport. In case of doubts, the buyer has to check inside the state of the product by the presence of the delivery man.

In case the packaging/product is damaged on arrival

Immediately after recieving the goods, the puchaser has to manage a meticulous inspection of the goods. In case of defect or damages from transport, it is imperative to specify, through the delivery note, acceptance with reservations concerning signs of damage before accepting it. The buyer must then inform the seller by mail or email (info@alterego-design.co.uk). In case of, within 2 (two) days after delivery of the goods, the purchaser doesn't contact ALTEREGO sprl to communicate the possible defects or damages noticed during the inspection, it is considered that the goods are fully accepted by the buyer in the state in which thay are and the right for any complaints expires after that delay.

The seller must be immediately able to control any complaints. The purchaser commits himself to give to the seller, in any circumstances, the possibility to repare the possible damages or defects.

The purchaser loses the rights and competences at his disposal if he didn't communicate his complaints in the delays noted above and/or he didn't give the seller the possibility to repare the possible damages or defects and/or if he didn't pay enough attention to discover the damages or defects as soon as possible.

If the complaints are justified in seller's eyes, the seller will have the possibility either to pay a compensation up to the value of the delivered goods or to replace the damaged or defect goods for free. The seller does not have to pay any additionnal compensations or damages, in any kind.

Guarantees

All our products benefit of:

· The legal guarantee of conformity

· The legal guarantee of hidden defect

· The constructor guarantee which cannot exceed 2 years

Considering his quality of intermediary, ALTEREGO sprl limits the guarantee on delivered products to the ones granted by his suppliers. As far as the conditions of the guarantee allows it, ALTEREGO sprl will limit his intervention to the replacement of defective products or to the refund of the amount paid by the customers without any right for claims for damages.

ALTEREGO sprl will not be liable for the non-intervention of his suppliers regarding the guarantee, for example in case of bankruptcy of the suppliers.

The buyer commits itself not to claim any compensation for material damage, whatever its nature, that himself or a third person could suffer next to having sold or used items from ALTEREGO sprl. For this reason, the customer signs away to have recourse against ALTEREGO sprl and acknowledges that ALTEREGO sprl is not able to guarantee that sold items don't harm third's rights.

Right to cancel according to Distance Selling Regulation 2000

According to Distance Selling Regulation 2000, the consumer has the right to inform the seller that he cancels his purchase, without any penalties and reasons, within 7 working days from the day after the delivery of the parcel.

ALTEREGO sprl decided to give to customers 15 working days to cancel his purchase after the date of receipt of the item.

In case of exercise of this right, the consumer has to send back the goods in the original packing and in brand new state to ALTEREGO sprl, to his own risks and at his own expenses. Once the item has arrived in our warehouse and has been inspected, we will then refund the buyer the full amount minus the original carriage charge.

Data protection information and declaration of consent

Because of his purchase on the website of ALTEREGO sprl, the customer expressly allows ALTEREGO sprl to process his personal data and to use them for administrative purpose, orders management, deliveries or invoicing, follow-up of solvency, marketing and advertising. Utilization of this information for marketing or advertising purposes depends on the agreement of the customers, given during the order.

ALTEREGO sprl commits itself to communicate those data only for needs from its subsidiaries, excluding any other third parties. The customer who has ordered on the website will be able, at any time, to consult and amend their own personal data that ALTEREGO sprl registered.

The customer has the right to oppose himself, on demand and for free, to the treatment of the information for marketing or advertising purposes. For further information, the customer can go and ask from the public register updated by the commission for private life protection in Brussels.

Miscellaneous

If any of these present conditions and terms should be declared nil or non-applicable, the other present conditions and terms keep in force, and that condition would be applicable to the extend allowed by the law.

The different parties accept, in the scope of their relations, every electronic pieces of evidence such as emails, back ups...

Conflicts about the conclusion, validity, interpretation or execution of the contract are only ruled by belgian law. In case of dispute, only the courts of the seller's head office are competent.

The failure to pay any of the deadlines may result in claims of property. In case of late payment more than 30 calendar days from the date of the relevant invoice, a fixed fine of 12% will be due to cover collection costs. In addition, an 8% interest (on an annual basis) on the amount due will be brought into account as from the 30th day of delay.In case of dispute, the courts of the judicial district of Liège (Belgium) which is located the headquarters of ALTEREGO sprl will be competent.
